Welcome to ECMBA. These Terms of Use ("Terms") govern your access to and use of the ECMBA website, services, and related platforms. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By accessing, browsing, or using the ECMBA website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, along with our Privacy Policy and Cookie Policy. These Terms apply to all visitors, users, clients, and members of ECMBA.

2. Services Description

ECMBA provides media and event coverage services, membership programs, entertainment content, community events, and related creative services. Our services include but are not limited to photography, videography, social media content creation, event documentation, branding consultation, and distribution support. The specific details, deliverables, and terms for each service are outlined in individual service agreements and package descriptions.

3. Booking and Payments

When you book a service with ECMBA, the following terms apply:

• All bookings require a deposit to secure your date and time slot
• Deposits are non-refundable unless ECMBA cancels the service
• Full payment is due before or on the day of service unless otherwise agreed
• Prices are subject to change without prior notice; however, booked services will be honored at the quoted price
• Additional services or add-ons requested during an event will be billed separately
• Payment methods accepted include cash, credit/debit card, and digital transfers

4. Cancellation and Rescheduling

We understand that plans change. Our cancellation and rescheduling policy is as follows:

• Cancellations made more than 72 hours before the scheduled event may receive a credit toward future services
• Cancellations made less than 72 hours before the event will forfeit the deposit
• Rescheduling requests should be made at least 48 hours in advance and are subject to availability
• ECMBA reserves the right to reschedule due to weather, safety concerns, or unforeseen circumstances

5. Intellectual Property

All content, media, designs, logos, and materials created by ECMBA are protected by intellectual property laws. The following terms apply:

• ECMBA retains copyright to all original content and media produced unless explicitly transferred in writing
• Clients receive a license to use delivered media for personal and promotional purposes
• Commercial use of ECMBA content requires written permission and may require additional licensing fees
• ECMBA reserves the right to use produced content for portfolio, marketing, and promotional purposes unless otherwise agreed
• Unauthorized reproduction, distribution, or modification of ECMBA content is strictly prohibited

6. User Conduct

When using our website and services, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of ECMBA or others
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt our services or servers
• Harass, abuse, or threaten other users or ECMBA staff
• Use our services for any unlawful or unauthorized purpose

7. Membership Terms

ECMBA membership is subject to the following conditions:

• Membership approval is at the discretion of ECMBA
• Members must adhere to ECMBA's community guidelines and code of conduct
• Membership benefits are non-transferable
• ECMBA reserves the right to revoke membership for violations of these Terms
• Membership fees and terms are subject to change with reasonable notice

8. Limitation of Liability

To the fullest extent permitted by law, ECMBA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service in question.

9. Indemnification

You agree to indemnify and hold harmless ECMBA, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of the State of Georgia.
