Licensing

This Licensing page outlines the terms under which ECMBA's media content, creative assets, and intellectual property may be used, reproduced, or distributed. By accessing or using any ECMBA content, you agree to comply with the licensing terms described below.

1. Ownership of Content

All content produced by ECMBA — including but not limited to photographs, videos, graphics, designs, text, audio recordings, and digital media — is the exclusive intellectual property of ECMBA unless otherwise stated in a written agreement. This content is protected under United States and international copyright laws.

2. License Types

ECMBA offers the following license types for its media content:

Personal Use License

This license is included with standard service packages and grants the client the right to use delivered media for personal, non-commercial purposes. This includes sharing on personal social media accounts, personal websites, and private use. Attribution to ECMBA is appreciated but not required for personal use.

Commercial Use License

A commercial license is required for any use of ECMBA content that generates revenue or is used in connection with a business, brand, or commercial enterprise. This includes but is not limited to advertising, marketing materials, product packaging, corporate websites, and commercial social media accounts. Commercial licenses must be obtained in writing and may involve additional fees.

Editorial Use License

Editorial use of ECMBA content is permitted for news organizations, publications, and educational institutions for the purpose of reporting, commentary, or education. Editorial use does not require a commercial license, but proper attribution to ECMBA is required. Content may not be altered beyond standard editorial cropping and color correction.

Exclusive License

An exclusive license grants the licensee sole rights to use specific ECMBA content for a defined period and purpose. Exclusive licenses are negotiated on a case-by-case basis and require a formal written agreement. Pricing for exclusive licenses depends on the scope, duration, and intended use of the content.

3. Usage Restrictions

The following uses of ECMBA content are strictly prohibited without explicit written permission:

  • Sub-licensing, reselling, or redistributing ECMBA content to third parties
  • Using content in any defamatory, obscene, or unlawful manner
  • Using content in connection with hate speech, discrimination, or violence
  • Altering, modifying, or creating derivative works without written consent
  • Removing or altering watermarks, credits, or metadata from ECMBA content
  • Using content for artificial intelligence training datasets without permission
  • Falsely representing the origin or ownership of ECMBA content

4. Portfolio and Promotional Use

Unless otherwise agreed in writing, ECMBA reserves the right to use all produced content for portfolio display, marketing materials, social media promotion, and website showcase. Clients who wish to exclude their content from ECMBA's promotional use must request this in writing prior to the event or service date. An additional fee may apply for promotional exclusion.

5. Stock Media and Third-Party Content

Some content on the ECMBA website or in deliverables may include stock media or third-party assets. These assets are subject to their respective license agreements and are not covered by ECMBA's license. Users are responsible for verifying the licensing terms of any third-party content.

6. Duration of License

Licenses are granted for the duration specified in the applicable service agreement or license document. If no duration is specified, personal use licenses are granted in perpetuity for the original client. Commercial and exclusive licenses have terms defined in their respective agreements and may be renewed upon mutual agreement.

7. License Termination

ECMBA may terminate a license if the licensee breaches any of the licensing terms. Upon termination, the licensee must immediately cease all use of the licensed content and remove it from any platforms or materials. Termination does not affect content that has already been permanently published in physical media.

8. Infringement

Unauthorized use of ECMBA content constitutes copyright infringement and may result in legal action. ECMBA takes intellectual property protection seriously and will pursue all available remedies for infringement, including but not limited to injunctive relief, statutory damages, and attorney's fees.
